1. Acceptance of Terms
By creating an account on Kismet, you agree to be bound by these Terms of Service. If you do not accept these terms, you must not use this application.
2. Eligibility & Safety
You must be at least 18 years old to create an account. By signing up, you warrant that you have never been convicted of a felony or a sex crime, and that you are not required to register as a sex offender anywhere in the world. Kismet does not conduct criminal background checks; you interact with other users entirely at your own risk.
3. Avatars & App Mechanics
Kismet is designed as a secure, avatar-based platform.
- No Real Photos: This platform relies on 2D customizable avatars. You agree not to attempt to upload, bypass, or share real photographs of yourself or others through any means.
- Messaging: Matches are permitted to communicate via text and audio messages. Kismet reserves the right to review reported messages to enforce platform community standards.
4. Community Standards, Moderation & Account Termination
Kismet is an independently developed platform, and maintaining a safe, respectful, and appropriate environment for its users is a priority. Users are expected to interact with others respectfully and in good faith.
The following behavior is prohibited, including but not limited to:
- Hate speech, harassment, bullying, intimidation, threats, or abusive behavior.
- Age-based, personal, or targeted harassment of another user.
- Spamming, financial solicitation, scams, fraud, or deceptive behavior.
- Sharing illegal content or promoting illegal activities.
- Manipulative, exploitative, malicious, or intentionally harmful behavior.
- Behavior that may reasonably create a safety, privacy, or security risk for another user or for Kismet.
- Any conduct that is inconsistent with the intended purpose, community standards, or safe operation of Kismet.
Administrative Moderation Rights
Kismet reserves the right, at its sole discretion, to review user activity, reports, complaints, available account information, and other relevant information for the purpose of enforcing these Terms and maintaining the safety and integrity of the platform.
We may take moderation action based on a user report, an administrative review, information available to us, or our own assessment of a user's conduct. A user report is not required for Kismet to take action.
Where, in our sole and reasonable judgment, we determine that a user's conduct, behavior, communications, intentions, or overall pattern of activity is inappropriate, harmful, disruptive, unsafe, abusive, or otherwise incompatible with Kismet or these Terms, we may take action against the account.
Such action may include, without limitation:
- Issuing a warning.
- Restricting or disabling specific features.
- Temporarily suspending the account.
- Permanently terminating the account.
- Restricting the creation or use of additional accounts.
- Restricting access from associated devices, identifiers, or other technical means where reasonably necessary to prevent abuse or circumvention.
Kismet is not required to provide the same moderation outcome in every case. The action taken may depend on the seriousness of the conduct, available evidence, previous behavior, reports received, the overall pattern of activity, and the potential risk to other users or the platform.
In serious or urgent circumstances, Kismet may suspend or permanently terminate an account without prior warning or notice where we reasonably believe that immediate action is necessary to protect users, the community, or the platform.
We may also take action where a user's conduct has not yet resulted in demonstrable harm but, based on our reasonable assessment of the available information, presents a sufficient risk of harm, abuse, disruption, or misuse of the service.
To the maximum extent permitted by applicable law, Kismet's moderation decisions are made at the discretion of the developer and are not required to be based solely on the number of reports received against an account.
Enforcement of Community Standards
Kismet maintains a zero-tolerance approach toward serious harassment, bullying, threats, scams, exploitation, and other conduct that may materially harm users or the platform. Depending on the circumstances, such conduct may result in immediate suspension or permanent termination.
Users may report concerns through the reporting and support mechanisms provided within Kismet. Kismet may review reported messages or other relevant information when necessary to investigate and enforce these Terms.
5. Limitation of Liability
This platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Kismet and its developer shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the app, including emotional distress or physical harm arising from online or offline interactions with other users.
6. Governing Law & Disputes
These Terms are governed by the laws of the developer's jurisdiction of residence, without regard to conflict of law principles. We encourage resolving any issues or disputes directly via our designated support channels first.
7. User Interactions & Information Sharing
Kismet facilitates communication between users but does not control, verify, or take responsibility for user behavior, intentions, or the accuracy of any information shared on the platform.
You acknowledge that any interaction with other users, including the sharing of personal information such as phone numbers, email addresses, social media profiles, or meeting in person, is done entirely at your own risk.
To the fullest extent permitted by applicable law, Kismet and its developer shall not be liable for any loss, damage, harm, or claims arising from or related to your interactions with other users, whether online or offline, including but not limited to misuse of personal information, fraud, harassment, or physical harm.
8. Security & System Risks
While we implement reasonable measures to maintain the security and availability of the platform, no system can be guaranteed to be completely secure or free from vulnerabilities.
By using the application, you acknowledge that the platform, like any information system, may be subject to unauthorized access, data breaches, service interruptions, or other security-related risks beyond our direct control.
To the fullest extent permitted by applicable law, Kismet and its developer shall not be liable for any loss, damage, or harm resulting from such events, including but not limited to data loss, unauthorized access to user information, or service disruptions.
